Protection Against Unfair Competition and Representation in Antitrust Cases

In accordance with Article 14 of the Federal Law of July 26, 2006 No. 135-FZ “On Protection of Competition,” acts of unfair competition are prohibited, including the following:

• Unfair competition through defamation
• Unfair competition through misleading information
• Unfair competition through improper comparison
• Unfair competition related to acquisition and use of exclusive rights to means of individualization of a legal entity, goods, works, or services
• Unfair competition involving the use of results of intellectual activity
• Unfair competition leading to confusion
• Unfair competition involving unlawful acquisition, use, or disclosure of trade secrets or other protected information
• Other forms of unfair competition

If actions against your organization or as an individual entrepreneur can be classified as unfair competition, you have the right to file a complaint with the regional antimonopoly authority or directly with the Federal Antimonopoly Service (FAS Russia) in case of violations in multiple regions. Filing such a complaint does not require payment of a state fee, and cases are reviewed by a special commission.

The rightsholder of intellectual property is entitled to choose between judicial or administrative (antimonopoly) protection of their infringed intellectual rights.
