Agreement on the Assignment of Exclusive Rights
Under an agreement on the assignment of exclusive rights, one party (the rightsholder) transfers or undertakes to transfer in full its exclusive right to the result of intellectual activity or to a means of individualization to another party — the acquirer of the exclusive right (Article 1234 of the Civil Code of the Russian Federation).
Such an agreement must be concluded in writing. The assignment of exclusive rights is subject to state registration with the Federal Service for Intellectual Property (Rospatent).
To prepare the documents for registering an agreement on the assignment of exclusive rights, the following documents are required:
- Application — in 2 copies;
- Agreement signed by both parties — in 2 copies;
- Document confirming payment of the state fee for registration;
- Power of attorney for the patent attorney from each party — in 2 copies;
- Unofficial copy of the agreement (unsigned).
