NEVA-PATENT provides services at all stages of industrial design patenting:
- Conducting a patent information search to verify whether the industrial design meets the conditions of patentability.
- Based on the search results – preparing the application documents for obtaining an industrial design patent (description, list of essential features, application form in accordance with current legal requirements).
- Filing the application materials with Rospatent, where the application is registered and the priority date is established (the applicant is notified of the registration number and the priority date).
Formal examination is carried out by Rospatent and includes verification of the presence of all necessary documents and compliance with the requirements for the application materials, as established by the Civil Code and Administrative Regulations.
If the result of the formal examination is positive, substantive examination of the industrial design application is conducted, which includes assessing whether the claimed design meets the patentability requirements (novelty and originality).
If, during the substantive examination, it is determined that the industrial design meets the patentability conditions, Rospatent issues a decision to grant a patent, and the design is entered into the State Register of Industrial Designs.
During the examination process, our patent attorneys handle the prosecution of the application until the industrial design patent is obtained.
The following documents are required for filing an application for an industrial design patent by a Russian applicant in Russia:
- Full and accurate name of the applicant (legal or natural person);
- Legal address of the applicant, as well as a postal address for correspondence;
- Full name and residential address of the authors of the industrial design;
- Brief description of the industrial design;
- A set of images:
– Three-quarter view (axonometry);
– Other views showing a complete and detailed representation of the product’s appearance;
- Technical drawing indicating dimensions (optional);
- Power of attorney in the name of the patent attorney signed by the applicant (no notarization or legalization required).
