Inventions
A patentable invention is defined as a technical solution in any field that relates to a product (in particular, a device, substance, microorganism strain, culture of plant or animal cells) or a method (a process of performing actions on a material object using material means) (Article 1350 of the Civil Code of the Russian Federation).
An invention can be granted legal protection if it meets the following patentability criteria:
- Novelty: the invention is considered new if it is not known from the prior art;
- Inventive step: for a person skilled in the art, the invention must not obviously follow from the prior art;
- Industrial applicability: the invention must be capable of being used in industry, agriculture, healthcare, or other sectors of the economy and social sphere.
The prior art is determined in accordance with paragraph 2 of Article 1350 of the Civil Code of the Russian Federation and includes all information that became publicly available anywhere in the world before the priority date of the invention.
The term of a patent for an invention is twenty years from the date of filing the initial application with the federal executive authority for intellectual property (FIPS).
The procedure for obtaining a patent for an invention takes at least 1.5 years from the date of application submission to the publication of patent information in the official bulletin.
Utility Models
A utility model is a technical solution that relates to a device (Article 1351 of the Civil Code of the Russian Federation).
A utility model can be granted legal protection if it meets the following patentability criteria:
- Novelty: the combination of essential features of the utility model is not known from the prior art;
- Industrial applicability: the utility model is industrially applicable if it can be used in industry, agriculture, healthcare, other economic sectors, or the social sphere.
The term of a patent for a utility model is 10 years from the date of filing the initial application with FIPS.
The procedure for obtaining a patent for a utility model takes approximately 6 months.
