NEVA-PATENT provides services for assisting with, preparing, and reviewing application materials for the inclusion of software in the Unified Register of Russian Programs for Electronic Computers and Databases maintained by the Ministry of Digital Development, Communications and Mass Media of the Russian Federation (the “MinTsifra Register”), as well as for submitting the application through the official website of the Register’s operator.
The MinTsifra Register was established in 2015 following amendments to Federal Law No. 149-FZ of July 27, 2006, “On Information, Information Technologies and Information Protection” (hereinafter the “Information Law”). The Register was primarily created to support the policy of import substitution in the Russian Federation and to ensure the information security of public authorities. Simultaneously with the creation of this Register, restrictions were introduced for public procurement of software not included in it.
Inclusion of software in the MinTsifra Register is required in order to receive state support.
As of today, registration of software in the MinTsifra Register offers the following advantages:
- Eligibility to participate in public and municipal procurement. Under current Russian legislation, the use of foreign software is restricted in state and municipal procurements. Only software of Russian origin is permitted, as confirmed by its presence in the MinTsifra Register.
- Eligibility for VAT benefits. Since January 1, 2021, transactions involving the transfer or assignment of rights to use digital products are exempt from VAT, provided that such products are included in the Register.
